我国《刑法》第236条规定：
Article 236  Whoever rapes a woman by violence, coercion or any other means shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years.以暴力、胁迫或者其他手段强奸妇女的，被判处三年以上十年以下有期徒刑。
Whoever has sexual intercourse with a girl under the age of 14 shall be deemed to have committed rape and shall be given a heavier punishment.奸淫不满十四周岁的幼女的，以强奸论，从重处罚。
Whoever rapes a woman or has sexual intercourse with a girl under the age of 14 shall, in any of the following circumstances, be sentenced tofixed-term imprisonment of not less than 10 years, life imprisonment or death:强奸妇女、奸淫幼女，有下列情形之一的，处十年以上有期徒刑、无期徒刑或者死刑:
(1)the circumstances being flagrant;（一）强奸妇女、奸淫幼女情节恶劣的；
(2)raping a number of women or girls under the age of 14;（二）强奸妇女、奸淫幼女多人的；
(3)raping a woman before the public in a public place;（三）在公共场所当众强奸妇女的；
(4)raping a woman with one or more persons in succession;（四）二人以上轮奸的；
(5) causing serious injury or death to the victim or any other serious consequences.（五）致使被害人重伤、死亡或者造成其他严重后果的。
