type 1 error refers to the situation that the null is rejected but the null is true(should not be rejected)(is it type 1 or type 2 error in the question, because it seems to me that 2 is more appropriate). 5% refers to the probability of type 1 error occurs, and has nothing to do with the test confidence interval.
